By using SenderFactory services, you agree to these Terms of Service. If you do not accept these terms, please do not use our services.

Service Description

SenderFactory is a SaaS platform that enables businesses to send bulk messages via WhatsApp Business API. Our services include:

• Bulk messaging via WhatsApp
• Contact list management and Excel import
• Creating and using message templates
• Delivery reports and analytics

Account Responsibilities

As an account holder, you are responsible for:

• Providing accurate and up-to-date information
• Maintaining account security and keeping your password confidential
• All activities performed under your account

Prohibited Use

The following uses are strictly prohibited:

• Sending unsolicited bulk messages (spam)
• Sharing illegal content or conducting illegal activities
• Sending messages containing harassment, threats, or hate speech
• Sharing viruses, malware, or malicious links
• Attempting unauthorized access

WhatsApp Policies

When using our service, you must also comply with Meta's WhatsApp Business Policy and Commerce Policy:

• Comply with WhatsApp Business Messaging Policy
• Obtain consent from recipients before sending messages
• Provide opt-out option to recipients

Credit System

Message sending works through a credit system:

• Credits are purchased in advance
• Each successful message delivery deducts 1 credit
• Credits do not expire
• Unused credits are non-refundable

Payment Terms

The following terms apply to credit purchases:

• Credit card and debit card payments accepted
• Prices include applicable taxes
• Payments are processed through Iyzico secure payment infrastructure

Intellectual Property

The SenderFactory brand, logo, software, and all content are our intellectual property. Using our services does not grant you any ownership rights.

Limitation of Liability

SenderFactory is not liable for service interruptions, data loss, or indirect damages. Our total liability is limited to the total amount paid by you in the last 12 months.

Indemnification

You agree to indemnify us from all claims, damages, and expenses arising from your violation of these terms or misuse of our services.

Termination

We reserve the right to suspend or terminate your account without notice if you violate these terms. You may close your account at any time.

Changes to Terms

We reserve the right to modify these Terms of Service. We will notify you of significant changes, and your continued use constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved under the jurisdiction of Istanbul courts.
